1. Introduction and Acceptance of Terms
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“Client,” “Parent,” “Guardian,” or “User”) and BAM Studio (“BAM Studio,” “we,” “us,” or “our”), governing your use of our website located at bamstudio.ca (the “Website”) and all services offered therein, including but not limited to dance classes, karate lessons, music instruction, fitness programs, summer day camps, birthday party packages, and studio rental services (collectively, the “Services”).

By accessing this Website, registering for any Service, or enrolling a minor in any program, you confirm that you have read, understood, and agreed to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, you must discontinue use of the Website and Services immediately.
These Terms apply to all visitors, registered users, and enrolled clients. BAM Studio reserves the right to update or modify these Terms at any time without prior notice. Continued use of the Website or Services following any modification constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
2. Definitions
For the purposes of these Terms, the following definitions apply:
“Client” refers to any individual who has registered for or purchased a Service from BAM Studio, including parents or guardians enrolling minors.
“Minor” refers to any person under the age of 18 years enrolled in a BAM Studio program.
“Session” refers to a single scheduled class, lesson, or program activity.
“Season” refers to the academic-year programming cycle, generally running from September through June of each school year.
“Summer Camp” refers to day camp programs offered during the July and August period at designated BAM Studio locations.
“Guardian” refers to any adult legally responsible for a Minor enrolled in BAM Studio programs.
3. Eligibility and Enrolment
3.1 Age Requirements
BAM Studio offers programs for participants aged 3 years and older. Specific age requirements apply to individual programs as indicated in the class descriptions on the Website. It is the responsibility of the enrolling Guardian to ensure the participant meets the age criteria for their selected program.
3.2 Registration Process
Enrolment in BAM Studio programs is completed through the registration system available on the Website. Enrolment is confirmed only upon receipt of full payment or an approved payment arrangement and issuance of a confirmation by BAM Studio.
3.3 Waitlists
Where a program has reached capacity, Clients may request placement on a waitlist. Waitlist placement does not guarantee enrolment. BAM Studio will contact waitlisted Clients in order of placement should a space become available.
3.4 Trial Classes
BAM Studio may offer complimentary trial classes at its discretion. Trial class availability is subject to capacity limitations. Participation in a trial class does not constitute enrolment in a program and does not create any obligation on the part of either party. BAM Studio reserves the right to modify or discontinue its trial class offering at any time.
3.5 Health and Medical Conditions
At the time of registration, Guardians must disclose any medical conditions, physical limitations, allergies, or special needs that may affect the participant’s safe participation in BAM Studio programs. BAM Studio is not liable for any injury, harm, or adverse outcome resulting from information not disclosed at the time of enrolment. BAM Studio reserves the right to refuse enrolment or participation where it determines, in its sole discretion, that a participant’s safe involvement cannot be reasonably assured.
4. Fees, Payment, and Refund Policy
4.1 Fees
All fees for BAM Studio programs are as published on the Website at the time of registration. BAM Studio reserves the right to adjust fees at any time, provided that enrolled Clients are given reasonable notice of any fee change affecting their current season.
4.2 Applicable Taxes
All fees are subject to applicable federal and provincial taxes as required by law. Prices displayed on the Website may or may not include taxes; applicable taxes will be clearly itemized at the point of purchase.
4.3 Payment Methods
BAM Studio accepts payment by the methods indicated on the Website at the time of registration. All transactions are processed in Canadian dollars (CAD).
4.4 Refund Policy
Season Programs: Refund requests submitted more than 14 calendar days before the start of the enrolled season will be honoured in full, less a $25.00 CAD administrative processing fee.
Refund requests submitted between 7 and 14 calendar days before the season start will receive a 50% refund of the total enrollment fee paid.
Refund requests submitted fewer than 7 calendar days before the season start, or after the season has commenced, are not eligible for a monetary refund. In such cases, BAM Studio may, at its discretion, offer a credit applicable to a future season or program.
Summer Camp: Refund requests for summer camp programs submitted more than 30 calendar days before the camp start date will be honoured in full, less a $35.00 CAD administrative fee.
Refund requests submitted between 15 and 30 calendar days before the camp start date will receive a 50% refund.
Refund requests submitted fewer than 15 calendar days before the camp start date are not eligible for refund. A credit toward a future program may be offered at BAM Studio’s discretion.
Medical Exception: In the event that a participant is unable to attend due to a medical condition confirmed by a licensed physician, BAM Studio will consider refund or credit requests on a case-by-case basis. Supporting documentation from a physician is required.
Trial Classes, Birthday Packages, and Studio Rentals: These bookings are non-refundable once confirmed. Rescheduling may be accommodated with a minimum of 48 hours’ notice, subject to availability.
4.5 Non-Attendance
Non-attendance at a scheduled session does not entitle the Client to a refund, make-up session, or credit, except as provided above under Section 4.4.
4.6 NSF and Chargebacks
In the event that a payment is declined, reversed, or subject to a chargeback, BAM Studio reserves the right to suspend enrolment until payment is resolved and to charge an administrative fee of $35.00 CAD for each such occurrence.
5. Program Schedule, Cancellations, and Modifications
5.1 Schedule Changes
BAM Studio publishes its program schedule on the Website and will make reasonable efforts to maintain the published schedule. BAM Studio reserves the right to modify program times, locations, instructors, or content where necessary. Reasonable notice will be provided to enrolled Clients.
5.2 Studio Cancellations
BAM Studio reserves the right to cancel or suspend individual sessions or entire programs due to circumstances including but not limited to: instructor illness or unavailability, inclement weather, building closures, public health directives, or insufficient enrolment. In such cases, BAM Studio will make reasonable efforts to provide a substitute session, a credit, or a proportional refund.
5.3 Statutory Holidays and School Breaks
Unless otherwise indicated, BAM Studio programs do not operate on Québec statutory holidays or during school break periods as observed by the Commission scolaire de Montréal. Clients should consult the season schedule published on the Website for specific dates.
5.4 Minimum Enrolment
BAM Studio reserves the right to cancel a program where minimum enrolment thresholds are not met. In such cases, enrolled Clients will receive a full refund of any fees paid for the cancelled program.
5.5 Instructor Changes
BAM Studio may substitute instructors at any time without notice. Instructor substitution does not entitle the Client to a refund or credit.
6. Code of Conduct
6.1 Participant Conduct
All participants are expected to conduct themselves with respect toward instructors, fellow participants, and BAM Studio facilities. Behaviour that is disruptive, discriminatory, abusive, or threatening toward any person will not be tolerated and may result in immediate removal from the program without refund.
6.2 Guardian Conduct
Guardians are expected to model respectful behaviour at all times when present on BAM Studio premises or when communicating with BAM Studio staff. BAM Studio reserves the right to refuse service to any Guardian whose conduct is deemed inappropriate, abusive, or threatening.
6.3 Dress Code and Equipment
Participants are expected to attend classes in appropriate attire as specified for their program. Specific requirements for footwear, uniforms, or equipment will be communicated at the time of enrolment or upon request. BAM Studio is not responsible for personal items lost, stolen, or damaged on its premises.
6.4 Punctuality and Attendance
Regular attendance and punctuality are essential to the participant’s progress and to the integrity of the group learning environment. Participants who arrive more than 10 minutes after the scheduled start of a session may be denied entry at the instructor’s discretion, for safety and program continuity reasons.
7. Photography, Video, and Image Rights
7.1 Studio Use
BAM Studio may photograph or video record classes, rehearsals, and performances for the purposes of documentation, marketing, social media, and promotional materials. By enrolling in a BAM Studio program, Guardians grant BAM Studio a non-exclusive, royalty-free, perpetual licence to use images or footage in which their child appears for these purposes.
7.2 Opt-Out
Guardians who do not wish their child’s image to be used for any of the above purposes must notify BAM Studio in writing at info@bamstudio.ca at the time of enrolment. BAM Studio will make reasonable efforts to accommodate such requests, though it cannot guarantee the complete exclusion of a participant from all incidental background imagery.
7.3 Guardian Photography
Guardians are permitted to photograph or video record their own child during open observation periods. Recording of other participants without the explicit consent of their Guardians is strictly prohibited. Use of any BAM Studio footage for commercial purposes without prior written consent from BAM Studio is prohibited.
8. Liability Waiver and Assumption of Risk
8.1 Inherent Risk
Physical activity, including dance, karate, acrobatics, and fitness training, carries an inherent risk of physical injury. By enrolling in a BAM Studio program, the Client acknowledges and accepts these inherent risks on behalf of themselves and any Minor for whom they are the Guardian.
8.2 Limitation of Liability
To the maximum extent permitted by applicable law, BAM Studio, its directors, employees, instructors, and agents shall not be liable for any direct, indirect, incidental, or consequential loss, injury, damage, or expense arising from or in connection with participation in any BAM Studio program, including but not limited to: physical injury during class, allergic reactions, loss or damage to personal property, or any circumstance arising from information not disclosed by the Client at the time of enrolment.
8.3 Emergency Medical Authorization
By enrolling a Minor in a BAM Studio program, the Guardian authorizes BAM Studio staff to seek emergency medical assistance on behalf of the participant in the event that the Guardian cannot be reached and the participant requires immediate medical attention. All costs associated with emergency medical care are the sole responsibility of the Guardian and the participant’s family.
8.4 Insurance
BAM Studio carries general liability insurance appropriate for its operations. Clients are encouraged to maintain their own personal health and accident insurance. BAM Studio does not provide personal health, accident, or travel insurance for program participants.
9. Intellectual Property
All content on the BAM Studio Website — including but not limited to text, images, logos, video content, class descriptions, program materials, and graphic design elements — is the exclusive intellectual property of BAM Studio or its licensed content providers and is protected under applicable Canadian copyright and trademark law.
No content from this Website may be reproduced, distributed, modified, published, or used for any commercial purpose without the express prior written consent of BAM Studio. Requests for permission may be directed to info@bamstudio.ca.
10. Website Use and Third-Party Links
10.1 Acceptable Use
Users of this Website agree not to engage in any conduct that could damage, disable, or impair the Website or its servers, interfere with other users’ access, or attempt to gain unauthorized access to any portion of the Website or its underlying systems.
10.2 Third-Party Links
The BAM Studio Website may contain links to third-party websites, including payment processors, scheduling platforms, and social media channels. These links are provided for convenience only. BAM Studio does not endorse, control, or assume responsibility for the content, privacy practices, or terms of any third-party website. Clients access third-party websites at their own risk.
11. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Province of Québec and the applicable laws of Canada. Any dispute arising from or related to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of the District of Montreal, Québec.
In the event of a dispute, BAM Studio encourages Clients to first contact Aireen Vargas directly at info@bamstudio.ca with a written description of the issue. BAM Studio will make reasonable efforts to resolve disputes informally within 15 business days of receiving a written complaint.
12. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable under applicable law, such provision shall be severed from the remaining Terms, which shall continue in full force and effect.

Contact Information: Home address, phone number(s), and email address of the Guardian or adult client.
Health and Medical Information: Medical conditions, physical limitations, allergies, or special needs disclosed at the time of enrolment. This constitutes sensitive personal information and is subject to heightened protection under Law 25.
Payment Information: Transaction details including payment method type, last four digits of card, billing address, and transaction confirmation. Full payment card numbers are processed exclusively by our third-party payment processor and are not stored by BAM Studio.
Program Preferences: Class selections, scheduling preferences, and program history.
Communications: Records of email or other written correspondence between you and BAM Studio.
2.2 Information Collected Automatically
When you visit the BAM Studio Website, we or our service providers may automatically collect:

BAM Studio does not knowingly collect personal information directly from minors through the Website.

- Marketing consent records: Duration of consent plus 3 years.
- Website analytics data: 26 months on a rolling basis.
Upon expiry of the applicable retention period, personal information is securely destroyed or anonymized in accordance with our data destruction protocol.

BAM Studio implements reasonable and appropriate technical and organizational measures to protect personal information against unauthorized access, disclosure, alteration, loss, or destruction. These measures include:

WAIVER AND RELEASE OF LIABILITY

This Waiver and Release of Liability (“Waiver”) is entered into between the undersigned Guardian (“I,” “me,” “my”) and BAM Studio, 5122 Sherbrooke Street West, Suite 102A, Montréal, Québec, H4A 1T2.
By completing online registration, I acknowledge that I have read, understood, and agreed to all terms of this Waiver.
1. Acknowledgment of Risk I understand and acknowledge that participation in physical activities including dance, karate, acrobatics, fitness training, and related activities at BAM Studio involves an inherent risk of physical injury, including but not limited to: sprains, strains, fractures, and other bodily harm. I acknowledge that these risks cannot be entirely eliminated regardless of the care taken by BAM Studio.
2. Assumption of Risk On behalf of myself and/or the Minor I am enrolling, I voluntarily assume all risks associated with participation in BAM Studio programs, whether known or unknown to me at this time.
3. Release of Liability To the fullest extent permitted by applicable law, I release, waive, and discharge BAM Studio, its owners, directors, employees, instructors, agents, and volunteers from any and all claims, demands, actions, or causes of action arising from participation in any BAM Studio program, including claims arising from the negligence of BAM Studio, its employees, or its instructors.
4. Medical Authorization I authorize BAM Studio staff to seek emergency medical assistance on behalf of the participant named in my registration in the event that I cannot be reached and emergency medical attention is required. I accept full financial responsibility for any costs incurred.
5. Medical Disclosure I confirm that I have disclosed all relevant medical conditions, physical limitations, allergies, and special needs for the enrolled participant at the time of registration.
6. Photo and Video Consent I consent to BAM Studio photographing and video recording the enrolled participant for use in promotional materials, social media, and documentation, unless I have opted out in writing.
7. Governing Law This Waiver is governed by the laws of the Province of Québec. Any dispute arising from this Waiver shall be subject to the jurisdiction of the courts of the District of Montréal.

We understand that life happens, and we have tried to build a policy that is fair to both our families and our instructors and studio. Please read this policy carefully before completing your registration.
Season Class Programs

Trial Classes: Non-refundable. Complimentary trial spots released if cancelled less than 24 hours in advance.
Birthday Packages and Studio Rentals: Non-refundable once confirmed. Rescheduling permitted with a minimum of 48 hours’ notice, subject to availability.
How to Request a Cancellation: All cancellation requests must be submitted in writing to info@bamstudio.ca with your full name, your child’s name, the program enrolled in, and your reason for cancellation. Verbal cancellations are not accepted. Processing time is 5 to 10 business days.
