U.S. Immigration FAQs

Frequently Asked Questions

Can Leiter Rahme represent me if I do not live in New York?
Yes. U.S. immigration law is federal. Our lawyers admitted to practice in New York represent clients in federal immigration matters throughout the United States.
Is U.S. immigration a major part of Leiter Rahme’s practice?
Yes. U.S. immigration is a core area of our practice, including business, employment, investor, family, permanent-residence, waiver, inadmissibility, border, citizenship and federal immigration litigation matters.
Do you regularly handle E-2 investor visas?
Yes. E-2 investor visas are an important part of Leiter Rahme’s U.S. immigration practice. We represent entrepreneurs and investors establishing, purchasing or expanding businesses in the United States, from investment structure and source-of-funds analysis through preparation of the E-2 application and consular process. We also advise on renewals, ownership changes, E-2 employees and dependent family members.
Can Leiter Rahme assist a Canadian company transferring an executive or manager to the United States under L-1A?
Yes. L-1A intracompany transfers are a significant part of our business immigration practice. We assist companies transferring qualifying executives and managers to existing U.S. operations as well as businesses establishing new U.S. offices. Where appropriate, we also advise on longer-term permanent-residence strategy, including EB-1C for qualifying multinational executives and managers.
I am a Canadian professional moving to the United States. Can you help with a TN application?
Yes. TN / USMCA professional applications are a core part of our U.S. employment immigration practice. We prepare complete TN application packages, assess occupational classifications, prepare clients for presentation at the border or preclearance and assist with refusals, renewals and changes of employer.
How do I know whether E-2, L-1A or TN is the right U.S. immigration strategy for me?
The appropriate classification depends on nationality, professional background, ownership interests, investment, corporate structure, proposed U.S. activities and long-term objectives. An entrepreneur may have both E-2 and L-1A options; a professional may potentially qualify for TN or another employment classification. Our role is not simply to prepare whichever visa a client initially asks about — we evaluate the available pathways and identify the strategy that best fits both the immediate objective and the longer-term immigration plan.
Why are your U.S. immigration legal fees at Canadian rates?
Because Leiter Rahme is headquartered in Canada, our U.S. immigration professional fees are structured at Canadian rates even though the legal work involves U.S. federal immigration law.
Is Leiter Rahme familiar with the U.S. Consulate General in Montréal?
Yes. Leiter Rahme has extensive experience with immigrant visa matters processed through Montréal and is included on the U.S. Consulate General Montréal’s List of Attorneys.
Do you handle U.S. family sponsorships?
Yes. We handle I-130 petitions, CR-1 and IR-1 immigrant visas, K-1 fiancé(e) visas, NVC processing, consular processing, direct consular filing where legally available, adjustment of status and related family-based matters.
Can an I-130 be filed directly with the U.S. Consulate?
In limited qualifying circumstances, yes. Leiter Rahme assesses eligibility and handles qualifying direct-filing requests where available.
Can you help if I have been refused entry to the United States?
Yes. We assess the legal basis for the refusal and advise on re-entry strategy, admissibility, border presentation, waivers and available corrective options.
Do you handle U.S. immigration waivers?
Yes. Our practice includes nonimmigrant and immigrant waivers, including I-192, I-212, I-601 and I-601A matters where applicable.
My U.S. immigration case has been pending for a very long time. Can you help?
Possibly. Depending on the agency, circumstances and length of delay, options may include government follow-up, escalation or federal court litigation through Mandamus or the Administrative Procedure Act.
Do you handle asylum cases?
No. Leiter Rahme does not accept asylum matters.
